Terms of Service

These Terms of Service govern your access to and use of OurSpace. By creating an account or using the platform in any way, you agree to these terms. If you do not agree, do not use OurSpace.

These terms form a legally binding agreement between you and OurSpace. Please read them carefully. If you have questions, contact us at ourwritingspaceofficial@gmail.com before using the platform.

1. Eligibility

To create an account and use OurSpace, you must:

  • Be at least 13 years old
  • Be capable of forming a binding agreement under the laws of your jurisdiction
  • Not be prohibited from using services like OurSpace under applicable law

By registering, you represent and warrant that you meet all of the above requirements. If you are using OurSpace on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

1.1 Age Restrictions and Mature Content

OurSpace allows users aged 13 and above to join the platform. However, the creation, drafting, or storage of R-18 content — including sexually explicit material, graphic violence, or other adult-only content — is strictly prohibited for users under the age of 18.

  • Users who are 13–17 years old may use OurSpace solely for age-appropriate writing. They may not create, draft, or store any R-18 or sexually explicit content on the platform, regardless of whether the content is fictional.
  • Users aged 18 and above may write mature or R-18 content, provided it does not violate any other provision of these Terms — including the absolute prohibition on sexual content involving minors.
  • By creating an account, you confirm that any R-18 content you produce on OurSpace is created by and intended for adults only.

OurSpace does not actively monitor content, but violations of this age restriction policy may result in immediate account suspension or termination. If you are a minor and have been found to have created R-18 content on the platform, your account will be subject to removal without prior notice.

2. Accounts

2.1 Registration

To use OurSpace, you must create an account by providing a valid email address and choosing a pen name for your space. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You may only create one account per person. Creating multiple accounts to circumvent restrictions or bans is prohibited.

2.2 Account security

You are responsible for maintaining the security of your account. This includes:

  • Keeping your password confidential and not sharing it with anyone
  • Using a strong, unique password for your OurSpace account
  • Logging out of shared or public devices after use
  • Notifying us immediately at ourwritingspaceofficial@gmail.com if you suspect unauthorized access to your account

OurSpace is not liable for any loss or damage arising from unauthorized access to your account that results from your failure to maintain account security. However, if you notify us of a security incident, we will work with you promptly to secure your account.

2.3 Account name

The pen name you use for your space is your identifier on the platform. You may not use a name that impersonates another person or entity, is offensive or inappropriate, or infringes on someone else's trademark or intellectual property. We reserve the right to require you to change your pen name if it violates these guidelines.

3. Your Content

3.1 Ownership

You retain full ownership of all content you create inside OurSpace — your chapters, character profiles, story outlines, beat sheets, notes, and any other writing you produce on the platform. Creating an account and using OurSpace does not transfer any intellectual property rights to us.

3.2 License to OurSpace

By uploading or creating content on OurSpace, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, host, process, and display your content — but only to you, for the purpose of delivering the platform's services.

This license does not permit us to:

  • Read, analyze, or use your writing content for any purpose beyond storage and display to you
  • Share your content with any other user or third party
  • Use your content to train machine learning models or AI systems
  • Reproduce, publish, or distribute your content

This license ends when you delete the content or close your account.

3.3 Your responsibility for content

You are solely responsible for the content you create and store on OurSpace. By using the platform, you represent that you own the content you upload or have the rights to use it, your content does not infringe on any third party's intellectual property rights, and your content does not violate any applicable law.

3.4 Prohibited content

You may not create, upload, or store content on OurSpace that:

  • Violates any applicable law or regulation
  • Infringes on the copyright, trademark, or other intellectual property rights of any person
  • Contains sexual content involving minors
  • Constitutes harassment, threats, or targeted abuse of any identifiable person
  • Is designed to facilitate illegal activity

OurSpace is a private writing workspace. We do not actively monitor your content, but we reserve the right to remove content and terminate accounts that violate these guidelines if violations are brought to our attention.

4. Acceptable Use

You agree to use OurSpace only for its intended purpose — as a personal writing workspace. You may not:

4.1 Technical restrictions

  • Attempt to access, tamper with, or disrupt the platform's servers, networks, or infrastructure
  • Attempt to gain unauthorized access to any other user's account or data
  • Use automated tools, bots, or scripts to access or scrape the platform
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Use the platform in any way that could damage, overburden, or impair its operation
  • Introduce malware, viruses, or any other malicious code

4.2 Account restrictions

  • Create accounts under false pretenses or impersonate any person
  • Transfer your account to another person without our written permission
  • Use another user's account without their permission

4.3 Platform restrictions

  • Resell or commercially exploit access to OurSpace without our written permission
  • Use OurSpace to build a competing product or service
  • Reproduce or copy any part of the platform's design, code, or content for commercial use

5. Plans and Payment

5.1 Free plan

OurSpace offers a free plan that gives you access to the core writing tools at no cost. The features available on the free plan are described on the platform and may change over time. We will give reasonable notice before removing features from the free plan.

5.2 Paid plans

OurSpace offers paid subscription plans with additional features. By subscribing to a paid plan, you agree that:

  • You authorize OurSpace to charge your payment method on a recurring basis (monthly or annually, depending on the plan you choose)
  • Your subscription will automatically renew at the end of each billing period unless you cancel it
  • Prices are displayed in Philippine Peso (PHP) or United States Dollars (USD) as indicated at the point of purchase

5.3 Payment processing

All payments are processed by Stripe. By subscribing to a paid plan, you agree to Stripe's Terms of Service and authorize OurSpace to charge your payment method through Stripe. OurSpace does not store your card number, CVV, or banking credentials.

If a payment fails, we will notify you and attempt to collect payment again. If payment cannot be collected within a reasonable period, your plan will be downgraded to the free tier.

5.4 Cancellation

You may cancel your paid subscription at any time through your account settings or by emailing ourwritingspaceofficial@gmail.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

OurSpace does not offer refunds for partial billing periods. If you cancel mid-period, you will not be charged again, but no refund will be issued for the remaining time.

5.5 Price changes

We may change the price of paid plans. If we do, we will notify you at least 30 days before the new price takes effect. If you do not wish to pay the new price, you may cancel your subscription before the price change takes effect. Continued use of the paid plan after the price change constitutes acceptance of the new price.

5.6 Refunds

Payments for OurSpace subscriptions are generally non-refundable. Exceptions may be made at our discretion for technical failures that prevent you from accessing paid features for an extended period. Refund requests should be sent to ourwritingspaceofficial@gmail.com with a description of the issue.

6. Intellectual Property

6.1 OurSpace's property

The OurSpace platform — including its design, code, interface, logo, brand elements, and all content created by OurSpace — is owned by OurSpace and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of OurSpace without our written permission.

6.2 Feedback

If you send us feedback, suggestions, or ideas for improving OurSpace, you grant us the right to use that feedback without restriction and without compensation to you. We appreciate feedback and may act on it, but we are not obligated to do so.

7. Privacy

Your use of OurSpace is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using OurSpace, you consent to our collection and use of your information as described in the Privacy Policy.

8. Term and Termination

8.1 Term

These terms are effective from the date you create an account and remain in effect until your account is closed or these terms are otherwise terminated.

8.2 Termination by you

You may close your account at any time by emailing ourwritingspaceofficial@gmail.com. Upon closure, we will delete your account and writing content within 30 days, subject to our data retention policy.

8.3 Termination by OurSpace

We reserve the right to suspend or terminate your account at our discretion if you violate any provision of these Terms of Service, engage in conduct harmful to OurSpace or other users, or if we are required to do so by law.

For most violations, we will give you reasonable notice and an opportunity to remedy the issue before taking action. For serious violations — including unauthorized access, illegal activity, or harmful conduct — we may terminate your account immediately without notice.

8.4 Effect of termination

Upon termination, your right to use the platform ends immediately. If your account is terminated for a violation of these terms, you may not create a new account without our written permission. Sections of these terms that by their nature should survive termination — including intellectual property provisions, disclaimers, and limitations of liability — will survive.

9. Platform Availability and Changes

We aim to keep OurSpace available and functional at all times, but we do not guarantee uninterrupted access. The platform may be taken offline for scheduled maintenance, emergency repairs, or events outside our control. We also reserve the right to modify, update, or discontinue features of the platform with reasonable notice. We are not liable for any loss arising from platform downtime or feature changes.

10. Disclaimers

OurSpace is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, OurSpace disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, warranties that the platform will be error-free or uninterrupted, and warranties regarding the accuracy of any content on the platform.

11. Limitation of Liability

To the fullest extent permitted by applicable law, OurSpace and its owner, employees, and service providers will not be liable to you for loss of data, indirect, incidental, consequential, or punitive damages of any kind, lost revenue or business opportunities, or damages arising from unauthorized access to your account.

Our total cumulative liability to you for any claims arising out of or related to these terms is limited to the greater of: (a) the total amount you have paid to OurSpace in the three months immediately preceding the claim, or (b) Philippine Peso 500.

12. Indemnification

You agree to indemnify, defend, and hold harmless OurSpace and its owner from and against any claims, damages, losses, liabilities, costs, and expenses — including reasonable legal fees — arising out of or relating to your use of the platform in violation of these terms, content you create or store on OurSpace that infringes on a third party's rights, or your violation of any applicable law or regulation.

13. Dispute Resolution

13.1 Informal resolution

Before filing any formal legal claim, you agree to first contact us at ourwritingspaceofficial@gmail.com and give us at least 30 days to resolve the dispute informally.

13.2 Governing law

These terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.

13.3 Jurisdiction

For any dispute that cannot be resolved informally, you and OurSpace agree to submit to the exclusive jurisdiction of the courts of the Republic of the Philippines.

14. General Provisions

14.1 Entire agreement

These Terms of Service and the Privacy Policy constitute the entire agreement between you and OurSpace regarding your use of the platform. They supersede all prior agreements, representations, and understandings.

14.2 Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

14.3 No waiver

Our failure to enforce any provision of these terms does not constitute a waiver of our right to enforce that provision in the future.

14.4 Assignment

You may not assign or transfer your rights or obligations under these terms to any third party without our written consent. We may assign our rights and obligations under these terms without restriction.

14.5 Force majeure

OurSpace is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, internet outages, government actions, or third-party service failures.

15. Changes to These Terms

We may update these Terms of Service at any time. When we make material changes, we will update the effective date at the top of this document, notify you by email at least 14 days before the changes take effect, and post a notice on the platform.

Your continued use of OurSpace after the effective date of any changes constitutes your acceptance of the updated terms.
